Green to Continue the Push for Impeachment

Representative Al Green has expressed his intention to resubmit articles of impeachment this year. He introduced articles twice last year, citing Trump’s bigotry and racism as evidence of his lack of integrity and unfitness for office, and, forcing a vote on the floor, summoned the support of 60 democrats. He is not dissuaded by Attorney General Barr’s summary of Mueller’s report, and the lack of evidence of conspiracy between the President and the Russian government. He maintains that Trump is unfit for office because of his discriminatory decisions and statements.

Green’s position is similar, if more narrow, to that which has been put forth by Professor Bowman who presents  “a view of impeachment as an essential tool in the case of a president who consistently violates legal and behavioral norms essential to the preservation of American constitutional order.”

The House is Coming Down

The Democrat controlled House is beginning to pursue investigation of President Trump independent of Robert Mueller. Adam Schiff, House Intelligence Chairman, plans to expand the scope of his inquiry to determine whether Trump’s business interests are influencing his foreign policy decision in nations other than Russia. Additionally, the Ways and Means Committee, for whom Rep. Bill Pascrell has been speaking, has announced its intention to collect and examine President Trump’s tax returns. Notably, other House Democrats, such as Speaker Nancy Pelosi, have urged patience on that front.

The Travel Ban, Constitutionality, and Impeachment

The Supreme Court held, yesterday, that the Trump Administration’s travel ban had “sufficient national security justification to survive a rational basis review,” and that therefore it would reverse the preliminary injunction granted by the District Court. This is an indication that the travel ban is constitutional, and allows it to go forth unhindered, at least for the time being. Because the travel ban has been cited in at least Representative Green’s impeachment resolution as evidence of the President’s “bigotry,” one might wonder what effect this decision will have on the President’s chances of impeachment.

While it could be argued that the Supreme Court decision could set some, perhaps ethereal, precedent, it is still Congress that decides whether the President will be removed. And while the Supreme Court’s decision could in some way be construed as an endorsement of the executive order, so too can Justice Sotomayor’s dissent remind Congress of the reason the travel ban was cited as an impeachable offense in the first place:  “[the] appearance of discrimination that the President’s words have created.” Though Trump’s “muslim ban,” may have been rolled back enough to be constitutional, it can still evidence the  President’s bigotry, and therefore could still contribute to his impeachment.

Rep. Green is Back on the Floor

Representative Green offered articles of impeachment on the House floor for the second time this morning. Those who read Rep. Green’s first set of articles, will know that they cited Trump’s continued sexism and bigotry, which “underminded the integrity of his office.” Specific examples of said bigoty were his Muslim ban, comments towards the Charlottesville protestors, and his attack on the kneeling NFL players. Added to this list now are the comments President Trump made during the presentation of the bipartisan immigration proposal, insulting immigrants from African nations, Haiti, and El Salvador  — his “shithole” comment. Green claims that Trump is trying to convert his bigotry into policy.

The timing of Green’s resolution is questionable. With a government shutdown looming, and Congressmen’s minds on things such as immigration reform, Green is unlikely to make any headway with impeachment. However, that has not stopped Green before. Despite the fact that House Minority Leader Nancy Pelosi has made it known that she prefers a more diplomatic approach to impeachment, Green has been vocal in the impeachment effort. It seems likely that Green cares less about the success of his efforts than he does about making a statement: that he will not tolerate bigotry in the Oval Office. Frankly, I can’t blame him.

Chairman Nunes on the Prowl

Representative Nunes, Chairman of the House Intelligence Committee, is using his position to take an offensive role against the Federal Bureau of Investigation (FBI). Nunes intends to issue a contempt citation against the agents who sent texts about President Trump,  and plans to issue a corruption exposé about the FBI. There has been some speculation that these offensive tactics, indicate that Special Investigator Mueller will soon be fired. If Nunes carries out his intentions, it may help to build a case for said termination.

Green’s Articles of Impeachment

Rep. Al Green, who read his article of impeachment on the House floor last month, is now pledging to put the articles to a vote by Christmas. 

Green’s articles of impeachment, which can be read here, allege that President Trump has “undermined the integrity of his office,” and “brought disrepute on the presidency.” His articles cite specific acts of the President including demonstrations of bigotry and racism through sexist remarks, demeaning NFL players, imposing a Muslim travel ban, accusing President Obama of tapping his phones, and suggesting that transgendered people should not be allowed in the military. Additionally, he alleges Trump promoted violence through his support of the Charlottesville protesters, behaved dishonestly by claiming he won the popular vote, and degraded constitutional rights by suggesting police not act kindly to arrestees.

How much support Al Green’s articles of impeachment will have in the House remains unclear.

NFL Stoking Flames in the House

This article reports that Representative Green, in the wake of President Trump’s criticism of NFL players, has pledged to file an impeachment resolution next week. Though unlikely to pass without Republican support, the impeachment resolution could act as a test of Green’s fellow democrats. They are faced with a choice between endorsing impeachment or sitting out of the vote, and in doing so must consider whether the action is premature and whether either path could alienate their voters.
