House Democrats are Taking Things Slow

Politco reports that Nancy Pelosi, incoming Speaker of the House, is reining in impeachment efforts in order to give Special Counsel Robert Muller more time with his investigation. She is joined in this effort even by progressive Democrats who voted to start impeachment efforts last year, such as Rep. Pramila Jayapal. Though representatives, such as California Rep. Eric Swalwell, recognize that the campaign finance law violations, established by Michael Cohen when he confessed to paying hush money to models Stormy Daniels and Karen McDougal, do constitute impeachable offenses, they feel they do not alone justify impeachment. It has been suggested that this may be in part because they are reluctant to risk the blow-back that Republicans faced after the impeachment of President Clinton for the mild offenses brought incident to the Lewinsky scandal. They are however planning to start oversight hearings in January.

House Democrats are wise to wait. With new reports that Saudi Arabia, the United Arab Emirates, and Turkey may have had their hands in President Trump’s election, it is apparent that whatever conspiracy exists, it has many more as of yet not-established parts. Additionally, as Professor Bowman has written, the impeach-ability of Trump rests on the slue of missteps he has committed since before and during his presidency. It will take the whole of his crimes, well established by Mueller’s investigation, to justify impeachment efforts.

Justices Signal that Revised Travel Ban is Constitutional

Oral arguments over the Trump Administration’s new travel ban occurred yesterday in front  of the Supreme Court. The conservative justices of the Court signaled that they believed the revised ban to be a constitutional exercise of executive power done in pursuit of national security. Significantly, Chief Justice Roberts indicated that President Trump’s statements detailing an intention to implement a “Muslim-ban” would likely not be considered in determining the order’s constitutionality.

If the Supreme Court ultimately confirms that the revised travel ban is constitutional despite Trump’s statements, it may have a negative effect on future impeachment proceedings. Representative Al Green’s impeachment resolution cited President Trump’s travel ban as one reason he should be impeached. Though an act may be both constitutional and worthy of impeachment, as they have far different standards, the Supreme Court decision could still set a precedent. It may act as an endorsement of sorts.

Rep. Green is Back on the Floor

Representative Green offered articles of impeachment on the House floor for the second time this morning. Those who read Rep. Green’s first set of articles, will know that they cited Trump’s continued sexism and bigotry, which “underminded the integrity of his office.” Specific examples of said bigoty were his Muslim ban, comments towards the Charlottesville protestors, and his attack on the kneeling NFL players. Added to this list now are the comments President Trump made during the presentation of the bipartisan immigration proposal, insulting immigrants from African nations, Haiti, and El Salvador  — his “shithole” comment. Green claims that Trump is trying to convert his bigotry into policy.

The timing of Green’s resolution is questionable. With a government shutdown looming, and Congressmen’s minds on things such as immigration reform, Green is unlikely to make any headway with impeachment. However, that has not stopped Green before. Despite the fact that House Minority Leader Nancy Pelosi has made it known that she prefers a more diplomatic approach to impeachment, Green has been vocal in the impeachment effort. It seems likely that Green cares less about the success of his efforts than he does about making a statement: that he will not tolerate bigotry in the Oval Office. Frankly, I can’t blame him.

Cohen Files Articles of Impeachment

Articles of Impeach, sponsored by Representative Steven Cohen, were filed in the House today. Five other House Democrats joined Cohen in endorsing the articles: Luis Gutierrez, Al Green, Marcia Fudge, John Yarmuth, and Adriano Espaillat. The articles charge President Trump with obstruction of justice, violation of the foreign emoluments clause, and undermining American institutions, specifically the courts and press.

Green’s Articles of Impeachment

Rep. Al Green, who read his article of impeachment on the House floor last month, is now pledging to put the articles to a vote by Christmas. 

Green’s articles of impeachment, which can be read here, allege that President Trump has “undermined the integrity of his office,” and “brought disrepute on the presidency.” His articles cite specific acts of the President including demonstrations of bigotry and racism through sexist remarks, demeaning NFL players, imposing a Muslim travel ban, accusing President Obama of tapping his phones, and suggesting that transgendered people should not be allowed in the military. Additionally, he alleges Trump promoted violence through his support of the Charlottesville protesters, behaved dishonestly by claiming he won the popular vote, and degraded constitutional rights by suggesting police not act kindly to arrestees.

How much support Al Green’s articles of impeachment will have in the House remains unclear.

Gutiérrez Joins the Impeachment Effort

According to this article from the Hill, Representative Luis Gutiérrez is supporting a group of Democrats who intend to file new articles of impeachment against President Trump this month. This action comes at the exasperation of Minority Leader Nancy Pelosi, a critique of the premature focus on impeachment; however, Rep. Gutiérrez claims that in light of the recent indictments (talked about here) the time is right. Representative Green, who has read his own article of impeachment to the House floor, agrees that it is not necessary to wait for the results of the Mueller investigation, because “impeachment is political” not criminal.

Whether Reps. Green and Gutiérrez are correct about the timing of impeachment remains to be seen, but it seems very unlikely that talks of impeachment will be quelled anytime soon. Things in the House are hot and getting hotter.

Sherman’s Articles of Impeachment

Here you can find the text of Representative Sherman’s resolution to impeach President Trump for obstruction of justice. The resolution reads like a criminal indictment: it is short, focused, and clearly establishes the President’s mental state at the time of the firing of  James Comey.

Sherman was the first representative to offer articles of impeachment in the House, and their success may depend on the pending investigation of Special Counsel Robert Mueller.

Pelosi on Impeachment

Minority Leader Nancy Pelosi has long stood on the outside of the impeachment efforts in the House. Rather than advocate impeachment, this article from newsweek reports, she suggests they give the President an intervention. Pelosi has a history of taking a more diplomatic approach with President Trump, which includes a private meeting in which they worked out an alternative to the Deferred Action for Childhood Arrivals program.

Pelosi has said she thinks Trump will “self-impeach.” However, that may not be the case if she continues with her diplomacy. Is it possible that a better President can be made out of Trump, or is she just buying him time?

Matters of impeachment are gaining momentum in the House after Representative Green read his articles of impeachment on Wednesday. Rep. Cohen intends to introduce his own articles of impeachment in the next couple of weeks. Here is an article summarizing the recent politics surrounding impeachment in Congress.

Though these resolutions lack the votes needed to pass through the House, they represent a growing support for the idea of impeachment.

Green Pulls Out

This article from the Washington Post reports that Representative Green read his impeachment resolution to the house yesterday. However, when it came time to introduce the resolution, Green was not available to offer it.

The article suggests that Green’s last minute dodge may have been the result of party pressure. Forcing a vote on impeachment at this time would be ineffective, because the Republicans have a majority of the House and are unlikely to vote in favor of it. In fact, a premature vote may harm the Democratic party, by putting them in the awkward position of deciding whether or not to endorse impeachment, and risking the alienation of a portion of their voters. This incomplete attempt in the House is an indication that the impeachment issue is not yet ripe.
